What is a Paternity Action? When there is a child born into the relationship, but the parties were not married to each other, a paternity action may be brought to establish child support duties and custody and visitation rights.

Does the Father have Automatic Paternity Rights? If the father has signed a voluntary declaration of paternity, rights and obligations follow. If not, a Petition to Establish Parental Relationship must be filed.

How is Paternity Determined? Unless the parties agree on parentage, a DNA paternity test is used to determine the probability of paternity.

How is Child Support Determined? Formulas established in the Judicial Council guidelines are used to calculate child support levels, pursuant to the ability to pay.

What About the Father’s Rights? A Judgment of Paternity offers the father an opportunity to reestablish a relationship through visitation or custody arrangements.
